These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer", "you", or "your") and AiGate ("AiGate", "we", "us", or "our") governing your access to and use of the AiGate service, including the AiGate dashboard, API, Cloudflare Workers deployment tooling, and all related software (collectively, the "Service").
By creating an account, clicking "I agree", or otherwise accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
AiGate is a platform that enables websites to become accessible to AI agents via the Model Context Protocol (MCP). The Service:
The Service does not store, cache, or serve your website content. All live page fetches occur in real time and data is discarded after each request. AiGate stores only extraction schemas and request metadata (timestamps, agent names, tool names, response codes).
You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for maintaining the security of your account credentials. You must promptly notify us of any unauthorised access to your account.
You may only register domains that you own or are authorised to manage. By connecting a domain, you represent that you have the authority to deploy workers and modify DNS or routing for that domain.
AiGate offers subscription plans as described on the Pricing page. Current plans include Starter ($29/month), Growth ($79/month), and Enterprise (custom pricing). Plan features and included request volumes are detailed on the Pricing page and may be updated from time to time with reasonable notice.
New accounts receive a 14-day free trial with Starter plan access. No payment method is required during the trial. At the end of the trial period, continued use of the Service requires a paid subscription. AiGate reserves the right to suspend trial accounts that it reasonably determines are being used abusively.
Subscriptions are billed monthly in advance. Your billing cycle begins on the date you start your paid subscription. Invoices are issued at the start of each billing cycle. Payment is due within 7 days of invoice issuance.
If your AI request volume exceeds the included monthly allowance for your plan, overage charges apply at the rates shown on the Pricing page:
Overage charges are calculated at the end of each billing cycle and added to your next invoice. The Service does not automatically suspend when you exceed your plan limit. You can configure spending alerts in your dashboard settings. You remain responsible for all charges incurred.
AiGate may change subscription prices with at least 30 days' written notice. Price changes take effect at the start of your next billing cycle following the notice period. Continued use of the Service after a price change constitutes acceptance of the new prices.
Subscription fees are non-refundable except where required by applicable law. If you cancel your subscription, you will retain access until the end of your current billing period. No prorated refunds are issued for partial months, except at our sole discretion.
Prices are exclusive of applicable taxes unless stated otherwise. You are responsible for all taxes, levies, or duties imposed by taxing authorities in connection with your use of the Service.
You agree not to use the Service to:
We reserve the right to suspend or terminate accounts that violate these prohibitions, without prior notice in serious cases.
AiGate stores: extraction schemas (CSS selectors and MCP tool definitions for your domain), request analytics metadata (timestamps, detected agent names, tool names called, response status codes, response times, IP country/city), and account information (email address, hashed password, billing details).
AiGate does not store, log, or retain the content of your web pages. Live page fetches occur in Cloudflare Worker memory and are discarded after each request. We do not store prices, product data, menu items, booking details, customer personal data, or any other business content from your origin server.
You retain ownership of your website content and all data on your origin server. You grant AiGate a limited, non-exclusive licence to access your website solely for the purpose of generating extraction schemas and serving AI agent requests as described in these Terms.
Raw request logs are retained for 90 days and then permanently deleted. Aggregated statistics (daily totals, top tools, agent counts) are retained for the duration of your subscription. Account data is retained for 30 days following account deletion, after which it is permanently removed.
The Service is built on Cloudflare's platform. By using the Service, you acknowledge that your data passes through Cloudflare's network and is subject to Cloudflare's own terms of service and privacy policy.
AiGate does not guarantee any specific uptime or availability. The Service is provided on a commercially reasonable efforts basis. We perform maintenance and updates from time to time, which may result in temporary unavailability.
Rate limits apply per domain as specified in your plan. The default limits are 100 AI requests per minute on the Starter plan and 500 per minute on the Growth plan. Rate limits may be temporarily lowered during periods of platform stress. You can configure custom limits within your plan's maximum via the dashboard.
The Service, including all software, algorithms, schemas, documentation, and visual design, is owned by AiGate and protected by copyright and other intellectual property laws. These Terms do not grant you any ownership interest in the Service.
The extraction schemas generated for your domain are derived from your website's structure. You own the underlying website content. AiGate retains ownership of the schema generation methodology, tooling, and any generic schema patterns derived from it.
The Service integrates with Cloudflare's infrastructure (Workers, D1, KV, R2, Analytics Engine, Pages). You must comply with Cloudflare's terms of service when using the Service. AiGate is not responsible for Cloudflare's acts or omissions, downtime, or changes to Cloudflare's pricing or platform.
AI agents that access your site via AiGate (Claude, ChatGPT, Perplexity, etc.) are third-party services operated by their respective providers. AiGate is not responsible for the actions of these agents or the decisions made by AI systems that access your data.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AIGATE DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT EXTRACTION SCHEMAS WILL BE ACCURATE OR COMPLETE.
AI agent behaviour is determined by third-party AI systems outside our control. AiGate makes no representations about how AI agents will interpret or use the data returned by the Service.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AIGATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL AIGATE'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO AIGATE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) AUD $100.
You agree to indemnify, defend, and hold harmless AiGate and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; (c) your website content or the operation of your origin server; or (d) any claim that your use of the Service infringes the rights of a third party.
You may cancel your subscription at any time via your dashboard settings. Cancellation takes effect at the end of your current billing cycle. On cancellation, the Cloudflare Workers deployed to your domain will remain active but will no longer receive schema updates or analytics support. You are responsible for removing any Workers from your Cloudflare account after cancellation.
AiGate may suspend or terminate your account immediately if you breach these Terms, fail to pay amounts due, or engage in conduct that we reasonably determine poses a risk to the Service or other customers. We will endeavour to provide notice where practicable.
Upon termination, your right to access the Service ceases immediately. Sections 6 (Data and Privacy), 8 (Intellectual Property), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), 12 (Indemnification), and 15 (Governing Law) survive termination.
AiGate may update these Terms from time to time. We will notify you of material changes by email and/or by displaying a notice in your dashboard at least 14 days before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those Terms. If you do not agree to the revised Terms, you must cancel your subscription before the effective date.
These Terms are governed by the laws of New South Wales, Australia. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia, except where mandatory consumer protection laws in your jurisdiction apply.
Before commencing formal proceedings, you agree to attempt to resolve any dispute with us in good faith by contacting us at hello@aigate.dev. We will attempt to resolve disputes within 30 days.
